Lawyer wins most of €9.72 court costs appeal

A lawyer in Vorarlberg has won most of an appeal over €9.72 in legal costs, ORF reported. The Innsbruck Higher Regional Court ruled that he was entitled to VAT on travel costs and reimbursement for postage, but not fees for downloading case documents.

The Feldkirch Regional Court had awarded the court-appointed lawyer €30 for travel, but rejected his claims for VAT and two postage charges, calling them part of general law-office expenses. He appealed over the remaining €9.72.

The higher court said the lawyer should receive VAT on his travel costs and the postage expenses. It denied reimbursement for €0.84 in fees to access documents in the electronic case file, saying the charges could vary or not arise at all, depending on the service used. No further appeal is possible on that amount.

The lawyer will receive €38.88 from the state, €8.88 more than the lower court had awarded.
