Munich does not have to put Oktoberfest tent spaces out to a Europe-wide tender, the Bavarian Supreme Regional Court ruled on Friday, BR24 reported.
The case concerned the allocation of the Paulaner and Schottenhamel large tents. Munich landlord Alexander Egger brought the legal challenge, arguing that the process was not lawful and calling for a Europe-wide tender.
The central question was whether assigning the tents amounts to a service concession. The court said the answer depends on the requirements Munich sets for the operators. It described the case as legally highly complex.
The dispute temporarily slowed preparations for the previous Oktoberfest.
