Swisscom did not violate competition law when expanding its fibre-optic network, the Swiss Federal Administrative Court has ruled, according to SRF. The court upheld the company’s appeal, rejecting the position of the Competition Commission.
The commission fined Swisscom just over 18 million francs two years ago and ordered it to take measures. The dispute concerns a network technology under which several customers share a line to a local exchange. Other telecom companies that provide services over Swisscom’s network have criticised the arrangement, saying it limits their options.
The court said Swisscom did not hold a dominant position in the relevant market identified by the commission, so there could be no competition-law violation. The ruling can be appealed to the Federal Supreme Court.
